ORDINANCE NO. 2011-01
REGULATING THE PARKING OF VEHICLES DURING CERTAIN MONTHS WITHIN THE TOWN OF HAVEN, SHERBURNE COUNTY, MINNESOTA
The Town Board of Supervisors for the Town of Haven, Sherburne County, Minnesota, ordains as follows:
Section One – Purpose. The purpose of this ordinance is to provide for the safety and welfare of the citizens of the Town through the regulation of parking on town roads during periods when snow removal is required.
Section Two – Definitions. Any term used in this ordinance and defined in Minnesota Statutes Section 169.011 shall have the meaning given it by that section.
Section Three – Parking of Vehicles Within a Right-of-Way.
Subd. 1. Seasonal Parking Ban. A seasonal parking ban shall go into effect on November 15 of each year and shall remain in effect until April 15 of the following year. During a parking ban, no vehicle shall be parked in any portion of a street or highway.
Subd. 2. 24-Hour Parking. In addition to the restriction in subdivision 1, no person shall park a vehicle in any portion of a street or highway for a period exceeding 24 hours. After 24 hours, the vehicle may be towed away and impounded at the owner’s expense.
Subd. 3. Safety. Under no circumstances shall a person park a vehicle in any portion of a street or highway in such a way as to create a hazard for the traveling public or interfere with maintenance of the Right-of-Way.
Subd. 4. Parking Enforcement. The Sherburne County Sheriff’s Department may issue a parking citation and sign a towing order. All parking citations shall include the license number of the vehicle if available, the date and hour at which the violation was found to exist, the nature of the violation, and any other necessary facts relating to the violation.
Subd. 5. Towingand Impounding. The Board is a towing authority under Minnesota Statutes Section 169.041 Subd 1. In accordance with Minnesota Statutes Section 169.041, the Board may tow and impound any vehicle found parked in violation of this ordinance. The Board may authorize a private towing company to tow and impound vehicles on behalf of the Town. Any impounded vehicle may be redeemed by the owner or the person parking the vehicle in violation of this ordinance by paying, to the entity which towed and impounded the vehicle, all applicable towing charges and storage fees.
Subd.6. Prima Facie Violation. The presence of any vehicle on any town road, when standing or parked in violation of this ordinance, is prima facie evidence that the registered owner of the vehicle the vehicle committed or authorized the commission of the violation.
